CLARIFICATION TEXT FOR PROCESSING OF PERSONAL DATA - PRIVACY POLICY

IDENTITY OF THE DATA CONTROLLER

In accordance with the Personal Data Protection Law No. 6698 (“KVK Law”), your personal data may be processed by PB DIŞ TİCARET LTD ŞTİ (“Company”) as the data controller, within the scope explained below.

PURPOSE AND LEGAL REASON FOR PROCESSING YOUR PERSONAL DATA

  • Based on the legal reason "establishment and execution of the contract" regulated in Article 5/2 (c) of the KVK Law; Your personal data may be processed for the purposes of carrying out goods/service sales processes within the scope of the establishment and execution of contracts to which our Company is a party.
  • Based on the legal reason "the ability of the data controller to fulfill its legal obligation" regulated in Article 5/2 (d) of the KVK Law, the Company; may process your personal data for the purposes of complying with the retention periods stipulated in the legislation to which the Company is subject, fulfilling other obligations stipulated in the relevant legislation, fulfilling the requests of courts and public institutions and organizations requesting information and other legal obligations.
  • Based on the legal reason "establishment, use or protection of a right" regulated in Article 5/2 (e) of the KVK Law, the Company; may process your personal data for the purposes of providing evidence in possible disputes and obtaining legal consultancy and technical support.
  • Based on the legal reason "legitimate interest of the data controller" regulated in Article 5/2 (f) of the KVK Law, the Company; may process your personal data for the purposes of ensuring customer satisfaction and carrying out quality standards processes, performing in-company operational activities, performing internal audit investigation activities, and data backup and storage.

TO WHOM AND FOR WHAT PURPOSE PROCESSED PERSONAL DATA CAN BE TRANSFERRED?

Your collected personal data may be transferred to the following groups of people for the purposes listed above and within the framework of the personal data processing conditions specified in Articles 8 and 9 of Law No. 6698.

  • Your personal data may be shared with the relevant bank for the necessary payment and collection transactions within the scope of the establishment and execution of the contract subject to processing.
  • With courts and public institutions and organizations requesting information when necessary within the scope of fulfilling our company's legal obligations;
  • It may be shared with financial consultancy and law offices and other consultants in order to receive legal support within the scope of establishing, exercising and protecting the rights of our company.
  • Group companies, archive companies, for the purposes of ensuring customer satisfaction and carrying out quality standards processes, carrying out in-company operational activities, carrying out finance and accounting affairs, performing internal audit investigation activities, carrying out storage and archive processes, provided that your fundamental rights and freedoms are not harmed within the scope of our company's legitimate interests, audit companies may be shared with our suppliers for the purpose of fulfilling the contract.
  • Based on the legal reason of explicit consent in the 1st paragraph of Article 9 of the KVK Law; Carrying out communication activities, storage and archive processes; It may be shared with the data storage and/or cloud service provider company whose servers are located abroad, for the purpose of benefiting from cloud and e-mail services.

 

METHOD OF PERSONAL DATA COLLECTION

  • Your personal data is collected by our Company through different channels, physically or electronically, from you personally or from third parties to whom you have given explicit consent for the purpose of transmitting it to our Company.

 

STORAGE OF YOUR PERSONAL DATA

Your personal data is stored based on the regulations in paragraphs "c", "ç" and "f" of Article 5 of the KVK Law and in accordance with the general principles specified in Article 4 of the KVK Law; Taking into account the periods specified in the Deletion and Destruction Policy regulated in accordance with Article 7 of the KVK Law;

  • Identity data of the product or service buyer company contact person is valid for 10 years from the establishment of the contract,
  • Identity and accounting data of the supplier official/employee 5 years from the establishment of the contract,
  • Identity and contact data of the transportation officer/employee 3 months from the delivery of the goods,
  • The identity, contact and professional experience data of the employee candidate are valid for 1 year from the date of CV evaluation,
  • Company camera footage is stored for 14 days from the date of recording and is destroyed at the end of the storage period.

 

DATA SUBJECT'S RIGHTS

As a data owner, you have the rights listed in Article 11 of Law No. 6698 by applying to our Company;

  • Learning whether personal data is processed or not,
  • Requesting information if personal data has been processed,
  • Learning the purpose of processing personal data and whether they are used for their intended purpose,
  • Knowing the third parties to whom personal data is transferred at home or abroad,
  • Requesting correction of personal data if they are incomplete or incorrectly processed,
  • Requesting the deletion or destruction of personal data within the framework of the conditions stipulated in Article 7 of the KVK Law,
  • Requesting that the correction, deletion or destruction of personal data be notified to third parties to whom personal data has been transferred,
  • Objecting to the emergence of a result that is unfavorable to the person by analyzing the processed data exclusively through automatic systems,
  • We hereby inform you that you have the right to request compensation for the damage in case of damage due to unlawful processing of personal data.

 

APPLICATION TO THE DATA CONTROLLER

As personal data owners, you can submit your requests regarding your rights in writing in accordance with the 1st paragraph of Article 13 of the KVK Law or in the Communiqué on the Procedures and Principles of Application to the Data Controller (https://www.resmigazete.gov.tr/eskiler/2018/03/20180310-6.htm ) to the Company using the regulated methods, our Company will finalize the request free of charge as soon as possible and within thirty days at the latest, depending on the nature of the request. However, if the transaction requires an additional cost, the Company will charge the fee at the tariff determined by the Personal Data Protection Authority.

In order to exercise your above-mentioned rights, your request includes the necessary information to identify you, as well as your explanations regarding your right to exercise the rights specified in Article 11 of the KVK Law; You can fill out the application form on our website and send a printed and signed copy to our address, deliver it personally, through a notary or send the relevant form to our KEP address with a secure electronic signature.
